520 _aWhich constitutional order are we talking about exactly? After the political democratic upheavals of the 1990s, marked by resistance, successes, and failures, sub-Saharan Africa has resolutely sought to establish a constitutional order capable of advancing a democratic rule of law. It drew inspiration from constitutional and extra-constitutional values, particularly the objectives and principles set out in the Constitutive Act of the African Union, such as good governance, popular participation, the rule of law, and human rights. The aim of this contribution is to deconstruct and reconstruct a new analytical framework based on current political and institutional crises, seen as obstacles to the establishment of a truly humane democratic order in Africa.
