520 _aIn France, collective bargaining has been marked for several decades by a decentralization toward the company level. In recent years, the company itself has been the subject of questions about its nature and legal status, after having long remained hidden behind the notion of the société. These two movements suggest that the company is in the process of being institutionalized, through the rise of an interest of its own which would be the subject of negotiations at this level. The present text aims to examine this hypothesis critically, adopting the dual viewpoint of labor law and company law. This double point of view will be mediated by the notion, central here, of interest.
