En effet, les discussions passées et présentes ne portent pas tant sur le fonctionnement de cette propriété que sur son existence même. Récemment, certaines contributions ont sollicité le cadre théorique des deux principes de justice de John Rawls pour justifier et concevoir les droits de propriété intellectuelle. Cependant, ces contributions arrivent à des conclusions contraires.
