520			_aThe Court of Justice of the European Union has imposed itself as a key player to defend the rule of law, in particular in reaction to attacks on the independence of the judiciary in the member states. Since 2018 and its important ruling Juízes Portugueses, the Court has fulfilled this function, first of all at the request of national courts, by way of preliminary rulings and as part of infringement proceedings brought by the Commission, as “guardian of the treaties” in the most worrying cases such as Poland.
520			_aLa Cour de justice de l’Union européenne s’est imposée comme un acteur incontournable pour défendre l’État de droit, tout particulièrement en réaction aux atteintes à l’indépendance du pouvoir judiciaire au niveau des États membres. Depuis 2018 et son important arrêt Juízes Portugueses, la Cour joue ce rôle, avant tout à la demande des juridictions nationales, par la voie du renvoi préjudiciel et dans le cadre des recours en manquement introduits par la Commission, « gardienne des traités » de l’Union dans les cas les plus préoccupants, comme celui de la Pologne.
