520			_aCet article interroge une thématique émergente dans les études de genre en se penchant sur la question des transidentités, et plus précisément sur la transphobie. Nous partirons, dans un premier temps, du cadrage juridique français pour nous permettre d’appréhender les espaces du droit qui protègent ou ne protègent pas de la transphobie. Puis, nous interrogerons l’hypo-efficacité du droit en matière de transphobie, comme généralement lorsqu’il s’agit de discrimination. Quelles sont les raisons du fort taux de non-recours au droit et ce alors même que les chiffres de la transphobie sont sans appel ? Enfin, nous proposerons une définition plus compréhensive en termes d’expériences notamment, afin de restituer l’épaisseur des discriminations qu’une approche juridique seule ne parvient pas à rapporter.
520			_aThis article investigates an emerging issue in gender studies by examining the question of transidentities, and more precisely transphobia. I will first explore the French legal framework, in order to understand when the law does protect or does not protect individuals from transphobia. I will then investigate weakness of the law when it comes to transphobia, as is generally the case with anti-discrimination law. In a context in which empirical data show the widespread existence of transphobia, how can we explain that so few individuals lodge a legal complaint? Finally, I will put forward a more comprehensive definition of transphobic discrimination based in particular on people’s experiences, in order to convey the complexity of discrimination that a purely legal approach cannot grasp.
520			_aEste artículo interroga una temática emergente en los estudios de género interesándose por la cuestión de las transidentidades, y más precisamente por la transfobia. Partiremos, en un primer momento, del marco jurídico francés para permitirnos aprehender los espacios de derecho que protegen o no protegen de la transfobia. Después, interrogaremos la hypo-eficacidad del derecho en materia de transfobia, como generalmente cuando se trata de discriminación. ¿Cuáles son las razones de la fuerte taza de no recurso al derecho y esto a pesar de que las cifras de la transfobia no dan lugar a discusión? Finalmente, propondremos una definición más comprensiva particularmente en términos de experiencias, con el fin de restituir el espesor de las discriminaciones que un enfoque jurídico sólo no permite caracterizar.
