520			_aLe fait que l’expertise menée par le Fonds des accidents médicaux ne présente pas les mêmes garanties procédurales que l’expertise judiciaire ne porte pas atteinte aux droits consacrés par l’article 6 CEDH dans la mesure où elle ne lie pas le juge qui lui seul déterminera si le rapport d’expertise qui lui est soumis contient des éléments pouvant être retenus à titre de renseignements, de présomptions ou de preuves. La responsabilité d’un médecin ne peut pas être retenue si un médecin de même spécialité normalement compétent et prudent, confronté aux mêmes circonstances, dans l’état de la science médicale au moment de son intervention et en fonction des informations dont il disposait à l’époque (quant aux antécédents du patient et aux résultats des examens médicaux pratiqués), aurait préconisé une intervention chirurgicale sans préalablement faire une nouvelle tentative de traitement conservateur.
520			_aThe fact that the expertise carried out by the Medical Accidents Fund does not offer the same procedural guarantees as the judicial expertise does not infringe the rights enshrined in article 6 ECHR insofar as it does not bind the judge which alone will determine whether the expert report submitted to him contains elements that can be retained as information, presumptions or evidence. A doctor cannot be held liable if a normally competent and prudent doctor of the same specialty, faced with the same circumstances, in the state of medical science at the time of his intervention and according to the information available to him at the time (as to the patient’s history and the results of the medical examinations carried out), would have advocated a surgery without first making a new attempt at conservative treatment.
