520 _aIf the practice of teleworking allows the exercise of a professional activity at a distance, and therefore why not outside the usual work environment in order to enjoy an environment traditionally reserved for leisure and tourism, it is necessary to respect the conditions of implementation and execution. In default, the employee is liable to a disciplinary sanction, which may go up to the termination of his employment contract. He may also not be covered for the risks incurred as a result of his activity, particularly in case of an accident. On the employer’s side, allowing workation to take place without special attention risks exposing him to various convictions, whether for non-compliance with the rules on working hours, rest or leave or for breach of its obligation to ensure the safety and health of employees which it is responsible.
