| 520 | _aRésuméPremière loi en matière de protection des personnes se prêtant à des recherches biomédicales, la loi Huriet de 1988 a montré ses limites durant la période de sa mise en application. Axée sur le distinguo entre « bénéfice individuel direct » et « bénéfice individuel indirect », cette loi rendait inintelligibles les recherches versus placebo et réduisait le bénéfice à sa dimension étroitement somatique. De plus, elle reléguait au second plan la notion de risque. Or il n’est pas de plus sûr moyen de protéger une personne que d’explorer tous les risques possibles, y compris les risques réputés « potentiels ». C’est ici que la recherche biomédicale croise le principe de précaution. Dans son avis n? 79, le Comité national d’éthique montre en quel sens il faut entendre le principe de précaution pour le rendre applicable en matière de recherche biomédicale. | ||

Moreover, it relegated to the back the very notion of « risk ». But there is no better way to protect someone than to explore every possible risks, even those that are said « potential ». At this point, biomedical research meets the precautionary principle. In its notice n? 79, the National Comity of Ethics showed how one has to understand the precautionary principle to make it compliant with biomedical research. | ||
