520			_aCette chronique couvre la période allant de juillet 2021 à juin 2022. Le Conseil d’État n’a une nouvelle fois rendu aucun arrêt de principe majeur, même si on notera une nouvelle annulation contentieuse fondée sur le principe de précaution. Mais la période est surtout marquée par un grand nombre de décisions de non-renvoi de QPC (questions prioritaires de constitutionnalité) liées à la Charte de l’environnement, qui posent encore et toujours la question des limites de l’office du juge du filtre. La Cour de cassation quant à elle n’a rendu qu’un seul arrêt sur la période couverte, indirectement lié à la protection environnementale. Il s’agit d’une décision de non-renvoi d’une QPC dans laquelle les articles de la Charte sont invoqués à titre presque anecdotique.
520			_aThis column deals with the case-law relating to the French environmental Charter before the Council of State and the Court of cassation over the last twelve months (July 2021 – June 2022). The Council of State has once again not issued any major decisions of principle, even if we note a new contentious annulment based on the precautionary principle. But the period was marked above all by a large number of decisions not to refer QPCs (preliminary rulings on constitutionality) related to the Charter of the Environment, which still raise the question of the limits of the filter judge’s office. The Court of cassation, on the other hand, has only issued one decision over the period covered, indirectly related to environmental protection. This was a decision not to refer a QPC in which the articles of the Charter were invoked almost anecdotally.
