Bien que relevant du droit privé, les conséquences théoriques et politiques de cette question débordent largement ce champ disciplinaire. Cet article présente en premier lieu la fonction du droit chez Leibniz, en faisant apparaître ses liens avec la théologie et la métaphysique d’une part, et avec la logique d’autre part. La deuxième partie aborde la question de savoir si la propriété est l’objet d’un droit chez Leibniz. On souligne alors la distance qui sépare sur ce point la perspective leibnizienne de celles de Hobbes ou de Locke, tant pour des raisons pratiques que pour des raisons théoriques.

Though pertaining to private law, the theoretical and political consequences of this issue go far beyond this sole domain. This article first addresses the function of right in Leibniz by unveiling its links with theology and metaphysics on one hand, and with logic on the other. The second part is devoted to the question of whether property is an object of right for Leibniz, and emphasis is particularly laid on the difference between the perspectives of Leibniz and Hobbes, as well as those of Locke, on both the practical and the theoretical level.
