520			_aLe « pouvoir sacré » ( potestas sacra) est-il la seule voie pour la participation des laïcs au gouvernement de l’Église ? Pour répondre à cette question, l’auteur entend d’abord cerner la nature de ce « pouvoir sacré » à Vatican  ii (I). Ce concile a mis en valeur la trilogie des fonctions prophétique, sacerdotale et royale ( tria munera) conférées par la consécration épiscopale : il a valorisé un langage plutôt théologique (II) sans disqualifier le langage juridique basé sur le binôme (pouvoir d’) ordre et (pouvoir de) juridiction, toujours présent dans le Code de 1983 (III). Sous le bénéfice de cette enquête, il y a légitimement lieu de se demander si, plutôt que de partir du « pouvoir sacré » (des clercs), il ne faudrait pas partir de la communauté ecclésiale et de sa mission, à savoir de sa cura animarum, pour envisager la participation des laïcs au gouvernement des communautés (IV).
520			_aIs “sacred power” ( potestas sacra) the only way for lay participation in the governance of the Church? In order to answer this question, the author will first identify the nature of this “sacred power” at Vatican ii ( i). This Council has highlighted the trilogy of prophetic, priestly and royal functions ( tria munera) conferred by episcopal consecration: it has valued a rather theological language ( ii) without disqualifying the juridical language based on the binomial (power of) order and (power of) jurisdiction still present in the 1983 Code ( iii). With the benefit of this investigation, it is legitimate to ask whether, rather than starting from the “sacred power” (of the clerics), we should not start from the ecclesial community and its mission, namely its cura animarum, in order to consider the participation of the laity in the governance of communities ( iv).
