Elle permet en particulier de relever la pluralité des modèles contenus dans le texte proposé par la Convention européenne. La nature du projet, entre traité et constitution, et sa finalité, entre fédération et confédération, entre démocratie et marché, ne ressortent pas du texte avec clarté, laissant une marge importante à l’interprétation des juges et à la pratique politique et institutionnelle.
