D’une part l’ amp est réservée à un couple composé d’un homme et d’une femme, vivants et en âge de procréer ; d’autre part toute rémunération est interdite en cas de don de gamètes et tout contrat portant sur la gestation pour le compte autrui est nul. L’ouverture et le libre accès dans d’autres pays à des traitements interdits ou impraticables sur notre territoire ont mis à rude épreuve le droit français. En de nombreux endroits les barrières ont dû céder pour s’adapter aux délocalisations procréatives. | ||

A Challenge to French Law French law imposes strict conditions on access to Assisted Reproductive Technologies ( art) treatments : on one hand only an alive, heterosexual couple at a reproductive age is allowed to profit from art treatment; on the other hand no compensation is given to gametes donors and in addition no surrogacy arrangements are enforceable. By contrast, the practices that are forbidden and in short supply in France are performed openly and inclusively in other countries. Consequently French law is facing complex issues surrounding cross‑border care. However the legal barriers are slowly being overruled. | ||

Auf der einen Seite ist die künstliche Befruchtung nur für gegengeschlechtliche Paare zugänglich, bei denen beide Paare noch am Leben sind und sich im Fortpflanzungsalter befinden. Auf der anderen Seite ist jegliche Bezahlung einer Gametenspende verboten; jegliche Verträge über Leihmutterschaft gelten als nichtig. Die Öffnung und der freie Zugang in anderen Ländern zu Behandlungen, die in unserem Land verboten sind, hat das französische Recht herausgefordert. Vielerorts sind die Barrieren gefallen, um sich an die prokreierenden Delokalisierungen anzupassen. | ||
