Pourtant, à l'examen, ce principe qui ne se trouve énoncé de façon explicite par aucune disposition légale s'avère être la résultante d'une construction jurisprudentielle de la chambre criminelle de la Cour de cassation. Il révèle aussi la conception d'un parquet unifié et hiérarchisé. Placé dans une position de coexistence avec le principe hiérarchique, sa pratique traduit une tension entre, d'un côté, autonomie et responsabilité de chaque membre du ministère public et, de l'autre, une soumission à l'autorité hiérarchique du chef de parquet.
