520			_aÀ partir de l’étude de cas d’un procès important de l’histoire de la colonisation française, celui des insurgés du village de Margueritte qui s’est tenu à la cour d’assises de l’Hérault en 1902, cet article se propose de réfléchir aux effets de la forme « procès » dans des situations dans lesquelles l’État est tenté d’adopter des pratiques autoritaires ou d’exception. Bien qu’il ne corresponde pas au modèle du « procès politique » habituellement étudié par le Cause Lawyering, le procès des insurgés de Margueritte va mettre en difficulté le pouvoir colonial dans la mesure où par sa forme même, par son respect des formes « normales » du procès prévues par la procédure judiciaire métropolitaine, il a pour effet de rendre visible et audible la réalité des pratiques répressives coloniales et devient ainsi source de contestation de la colonisation.
520			_aThis article is based on a study of an important trial during the French colonization period, which was held in 1902 in the criminal court of Montpellier against the rebels of the Algerian village of Margueritte. The objective of this article is, therefore, to question the effects of the trial form in situations in which the State is inclined to adopt authoritarian or exceptional practices. The trial of the Margueritte rebels does not correspond to the model of political trial usually analyzed by Cause Lawyering. However, it has destabilized the colonial power precisely because the respect of the forms and procedures of the “normal” trial has made visible and audible the reality of colonial repressive practices and, therefore, has become a source for contesting French colonization in general.
