On en trouve trace dans de nombreuses législations, au rang desquelles celle introduisant une médiation pénale dans la procédure belge. Il s’agira ici de mettre en évidence la part que joue la proximité dans la légitimation de cette procédure et de nous interroger sur la nature de ladite proximité. Car si celle-ci est systématiquement présentée comme l’instrument d’une autonomisation des parties, rien n’exclut qu’il en soit fait un autre usage. Elle pourrait aussi bien être l’instrument d’une « hétéronomisation » des individus en présence et mettre à profit le rapprochement pour mieux obtenir une conformité à des injonctions extérieures. | ||

This text considers the role of proximity in legitimating that procedure, and it considers the nature of that proximity. Although proximity is commonly referred to as an instrument for giving the parties autonomy, there is nothing to prevent it being put to other uses. Such proximity can also be used to achieve “heteronomization” of the individuals present, thereby encouraging a rapprochement leading to conformity with external rules. | ||
