520			_aEn Guyane française, un tiers de la population est constitué d’étrangers, quotidiennement confrontés à des administrations chargées de la régularité de leur présence sur le territoire. Or, la légalité de ces pratiques administratives, souvent défavorables aux étrangers, est sujette à controverse. Cet article tente de cerner les multiples logiques sociales des débats et des négociations entre les divers acteurs de la politique migratoire autour du droit des étrangers. Il montre que le droit dérogatoire s’appliquant à ces derniers, et justifié politiquement par « l’exceptionnalité » de la situation, ainsi que la difficulté à imposer un contrôle des pratiques administratives, est lié au contexte postcolonial guyanais. Ces éléments spécifiques renforcent l’effet répressif du pouvoir discrétionnaire des administrations en ce domaine, et constaté ailleurs.

The legality of these administrative practices, often detrimental to foreigners, remains controversial. This article attempts to identify the multiple social logics of discussions and negotiations between the various actors of this migration policy. Specifically, it shows that derogatory laws are politically justified by the situation’s supposed “exceptionality.” The difficulty in controlling administrative practices is likewise linked to the postcolonial context of French Guiana. These specific logics strengthen the repressive effect of the discretionary power of these administrations found elsewhere.
