520 _aBased on an analysis of case law, this article studies (a) how specific protections have been progressively strengthened to protect people in detention, especially the most vulnerable ones, and (b) the protections that have been incorporated by states, in particular France, and the obligations that states, or at least some of them, are trying to exempt themselves from. The article also explores the ethical and legal tension between deprivation of liberty and the risk of deprivation of dignity, and the conditions according to which the prison system may adapt to the various vulnerabilities of prisoners.
