520 _aThe energy sector has undergone substantive legislative changes over the past years. Given the specificity of this sector and the aim of legislators to make the supply of energy available to customers without interruption, the EU adopted on October 20, 2010 a regulation aiming at ensuring a permanent supply of gas to the population. The role of the Commission in coordinating the measures adopted by member states was also strengthened. These legislatives changes are in line with the objective of European legislators to place the energy sector into the European economic model of a common market and to open the energy sector, which used to be monopolized, to competition. In addition, the energy sector raise policy considerations related to the protection of the environment, which requires the use of clean and renewable energy sources. Both considerations are in a triangular relationship with the Lisbon Treaty, which called for the liberalization of the sector, the Kyoto Protocol, which called for the protection of the environment, and the Moscow Agreement, which aimed to ensure continuity in the supply. This brief study sheds some light on how the energy sector is regulated as well as on the case law resulting from practice. In addition, the current policy reforms around this public good contained in the Nome regulation and through cooperation between the Commission for the Regulation of the Electricity Sector and the Commission for the Regulation of Financial Markets are also discussed.
