520			_aRésuméLa fiction juridique du consentement conçu comme l’aboutissement d’une décision rationnelle venant d’en haut doit être confrontée et non opposée à la réalité médicale d’un consentement progressivement élaboré, enraciné dans l’inconscient. Dans le cas des soins sous contrainte, l’éthique psychiatrique, indissociable de l’intention thérapeutique, ouvre la possibilité de dépasser le paradoxe du respect du principe du consentement par le respect de la dignité de son élaboration.
