520			_aLes ADPIC (accord sur les droits de propriété intellectuelle touchant au commerce) ont renforcé la propriété intellectuelle dans le domaine pharmaceutique et ont fait l’objet de vives critiques de la part des pays à faible revenu face aux carences dans l’accès aux médicaments. Dans un contexte de pressions externes et de contraintes économiques nouvelles, certaines firmes pharmaceutiques se sont engagées dans des démarches partenariales avec des acteurs internationaux et locaux non marchands. Ces partenariats sont souvent annoncés comme une solution aux problèmes d’accès des pays pauvres aux médicaments. Cet article s’interroge, à partir de deux cas d’étude, sur les potentialités et les limites de telles initiatives, en examinant en particulier leur efficience et leur impact en termes de durabilité du développement humain.
520			_aINTELLECTUAL PROPERTY RIGHTS (IPRS) AND ACCESS TO MEDICINE : THE IMPACT OF PUBLIC/PRIVATE PARTNERSHIP AGREEMENTS The reinforcement of IPRs protection resulting from the entry into force of the TRIPs agreement has significant consequences on access to medicine in poor countries. This very sensitive issue has provoked vivid debate and a great deal of controversy. Public/private partnership agreements between international organizations active in the health field, such as the WHO, NGOs and pharmaceutical companies are amongst strategies explored in order to overcome the drawbacks of the enhanced protection of IPRs on access to medicine. This article analyzes the efficiency of those partnership agreements with a focus on their potential as well as the challenges they face in ensuring improved access to medicine in poor countries.
