| 520 | _aLa Tunisie s’est dotée de différents mécanismes juridiques protecteurs de l’environnement. En application du principe de prévention, une étude d’impact sur l’environnement est exigée avant la réalisation de certains projets pouvant lui porter atteinte. L’objectif étant d’éviter les sources de pollution plutôt que d’en réparer les dommages. Elle permet, ainsi, de prendre une longueur d’avance sur les origines des pollutions en mesurant au préalable les effets des activités humaines sur l’environnement. De ce fait, elle constitue une condition de la jouissance du droit à un environnement sain et contribue efficacement à la protection l’environnement. Toutefois, et dans l’objectif de simplification des procédures administratives relatives à l’obtention d’autorisations, le régime juridique de l’EIE a subi un changement de taille, ce qui a causé un fléchissement déplorable de la protection de l’environnement. | ||

To apply the precautionary principle, an environmental impact study is required before implementing certain projects that are potentially harmful to the environment. The goal is to avoid sources of contamination rather than repair damage. By measuring in advance the impact of human activities on the environment, environmental impact studies make it possible to stay one step ahead of the pollution origin, and thus constitute a prerequisite for exercise the right to a healthy environment as well as contribute effectively to environmental protection. However, in an effort to simplify administrative procedures for obtaining permits, the legal regime governing of the EIE has undergone a major change, leading to a significant decline in environmental protection. | ||
