Pour autant, cette question se pose désormais avec une particulière acuité en ce qui concerne plus spécifiquement les accords collectifs négociés au regard de l’expansion de la négociation collective. Prenant soin de distinguer l’efficacité de l’effectivité, la présente étude définit le premier terme comme l’atteinte d’un objectif concret, prédéterminé par les parties. À l’aune des contours de la notion, mais également en s’inspirant de la pratique, les outils participant à l’efficacité des accords collectifs négociés seront analysés. | ||

However, this question is now being raised with regard more specifically to collective agreements negotiated in the light of the expansion of collective bargaining. Taking care to distinguish between effectiveness and efficiency, this study defines the first term as the achievement of a concrete objective, predetermined by the parties.
