Grâce à elle les juristes transposent dans un univers de concepts les données du réel qu’ils observent et qu’ils se donnent pour tâche d’appréhender. Ce faisant, par nécessité, ils les simplifient, et parfois même, par raison, ils les transforment, construisant ainsi une vision artificielle de la réalité. Mais cette dernière tient sa revanche sur son reflet dans le droit car le processus de qualification juridique ne s’avère pas toujours capable de remplir pleinement son office. En outre, le juriste n’exclut jamais la possibilité de reconsidérer, par empirisme, le résultat de l’opération pour s’adapter aux exigences du réel.
