520			_aDans le champ social, le rapport à la contrainte est ambigu. Le Code de l’action sociale et des familles (art. L116-1) rappelle que l’action sociale et médico-sociale tend à promouvoir à la fois « l’autonomie et la protection des personnes ». La recherche du consentement de l’individu est également perçue comme le prérequis d’une démarche éthique : l’accompagnement proposé doit permettre de trouver, avec la personne, les solutions adaptées pour surmonter les difficultés qu’elle rencontre. Mais, qu’advient la participation de l’enfant et de ses parents dans le champ de la protection de l’enfance ? Lorsqu’un enfant est en danger ou en risque de l’être au sein de la sphère familiale, il est nécessaire de trouver un équilibre entre les différents droits en présence. Cette contribution vise ainsi à étudier les normes qui régissent l’intervention de la puissance publique et déterminent, in fine, le niveau de consentement et de contrainte à l’égard de l’enfant et des titulaires de l’autorité parentale lors d’une mesure de protection de l’enfance.

The Code of Social Action and Families (art. L 116-1) stipulates that social and medico-social action tends to promote both “the autonomy and the protection of individuals”. The search for the individual’s consent is also seen as a prerequisite for an ethical approach: the proposed assistance must enable the person to find, together with the person, the appropriate solutions to overcome the difficulties he or she encounters. But what happens to the participation of the child and his/her parents in the field of child protection? When a child is in danger or at risk of being in danger within the family sphere, it is necessary to find a balance between the different rights involved. This article studies the norms that govern the intervention by the public authority and determine the level of consent and constraint employed with respect to the child and to the holders of parental authority, during a child protection measure.
