En l’espèce, la tenue d’une séance d’expertise par visioconférence, telle que convoquée par l’expert judiciaire, n’aurait pas permis d’assurer, de manière aussi efficace, le huis clos, la confidentialité et le principe du contradictoire applicables à une réunion d’expertise. Les droits de la défense des parties ne sont pas non plus assurés de manière équivalente lors d’une réunion par visioconférence. |
