| Summary, etc. | La motivation des décisions de justice porte sur des questions avec une forte charge émotionnelle, spécialement en droit pénal. En même temps, la formation juridique incite à dépassionner les débats. La loi fondamentale allemande ( Grundgesetz), comme la Convention européenne des droits de l’homme, exigent l’objectivité, tandis que la section 267 du Code allemand de procédure criminelle requiert que la motivation soit complète, claire et transparente. C’est dans ce cadre que les émotions doivent être régulées et articulées entre elles. Il en résulte une démarcation entre les styles judiciaires, d’une part, et les styles littéraires et journalistiques, d’autre part. Cet article tente de clarifier la manière dont la motivation est établie dans la procédure pénale allemande. |

| Summary, etc. | Judicial reasoning, especially in criminal law, deals with emotionally charged issues. Dispassion is not, however, only deeply rooted in legal education. German Basic Law ( Grundgesetz), as well as the European Convention on Human Rights, demands objectivity, and Section 267 of the German Code of Criminal Procedure requires completeness, clarity, and transparency. This is the framework in which emotions are regulated and articulated. Thus, a dividing line must be drawn between, on the one hand, judicial styles, and, on the other, literary or journalistic styles. The article clarifies the court's reasoning in German criminal procedure. |
