| Summary, etc. | La qualification juridique de l’embryon ne pose pas de difficultés particulières : cet être humain est une chose corporelle de nature humaine, dépourvue de la personnalité juridique.Cependant la congélation affecte son humanité : il n’est plus qu’une chose fabriquée en laboratoire qui échappe au temps. Conservé dans l’azote liquide, il ne meurt pas c’est pourquoi il faut mettre fin à sa conservation.Tant qu’ils répondent à un projet parental précis, celui pour lequel ils ont été fabriqués et conservés, les embryons congelés sont identifiés par lui. Ils sont uniques et non interchangeables. En revanche, sans projet parental, les embryons congelés qui peuvent être accueillis par n’importe quel couple infécond ou ceux qui sont donnés à la recherche, deviennent des choses de genre interchangeables.Bien qu’êtres humains, ils sont traités comme les éléments et produits du corps humains, choses humaines. |
