Ce phénomène, loin d’être marginal, est sûrement sous-estimé et difficilement appréhendable par la pratique en raison de l’état du droit de la propriété intellectuelle qui, au contraire, est de nature à l’encourager. Le présent article présente cette problématique et envisage quelques pistes pour mieux lutter à l’avenir contre ce type d’abus, la première étape résidant dans sa prise de conscience. |
