| Summary, etc. | Tirant sa force de son unité, mais également de sa diversité, le devoir au secret professionnel connaît une multitude d’applications, dont le point commun réside dans la protection de toutes les informations obtenues dans le cadre de l’exercice d’une profession. Son extension à des entités de plus en plus nombreuses conduit également à multiplier les exceptions au devoir afin que les informations essentielles au fonctionnement de chaque profession puissent transiter utilement. Mais derrière ces exceptions légitimes au secret professionnel, il existe des applications divergentes dont l’existence peine à se justifier. Ainsi, là où le secret professionnel de l’avocat ou du banquier cède face au droit à la preuve, le secret professionnel du notaire reste intact. Une harmonisation des secrets professionnels est-elle alors envisageable ou souhaitable ? |
