The disciplinary decisions of the Superior Council of the Magistracy through the eyes of the Council of State
Type de matériel :
74
The Superior Council of the Magistracy is responsible for the disciplining judicial magistrates to ensure that their professional obligations are respected. The sanctions taken are subject to control by the Council of State in application of a praetorian jurisprudence that has never been challenged. Such competence as a judge of cassation is not without question when one examines the organization of disciplinary measures for administrative magistrates who benefit from a significantly different regime whose transparency leaves a lot to be desired.
