Negationist Theses and Freedom of Expression in France

To combat the revisionist views which deny the existence of gas chambers and the Holocaust during World War II, France has supplemented its antiracist legal apparatus with a special law, the « Gayssot act » (July 1990). This article analyses the history and implementation of that law through judicial decisions. It questions its legitimacy, its role, the concept of « misuse of law », its effects on freedom of speech and on the search for historical truth.
