Judging managerial misconduct. Moral harassment as a pathology of powe within the company

Hierarchical relationships within organizations are a major issue and the manager’s work of supervising can sometimes be perceived as an excess of power. Such excess is yet qualified as moral harassment (or mobbing). This legal category measures deviance in a managerial activity and constitutes a misconduct which justice can sanction. Based on the analysis of a sample of judgments using the category of moral harassment for qualifying managerial behaviors, the article deals with the study of these misconduct behaviors. It chooses that these managerial misconducts are now considered as psychosocial risk factors, that can be collectively handled, contrary to the perception of moral harassment as a purely individual deviance.
